Q: What exactly is a personal injury case?

A:  A personal injury case is a claim against another who has been careless or intentionally injured you.

Q:  How do I know if I have a personal injury case?

A:  If you have been injured from the carelessness of another you probably have a Utah injury legal case.  When we screen your case we will decide if we think you have a case and if it is a case we want to pursue.

Q:  How long do I have to make a claim for personal injuries?

A:  The time period depends on which statute of limitation applies to your Utah injury legal case.  A statute of limitation is a law that limits the time for you to file suit on your claim.  If not filed or settled in that time period the claim is lost.

Q. When should I hire a personal injury attorney?

A. You should hire an attorney on your Utah injury legal case right after your injury if you can find one who will take your case. Some lawyers say, "call us when you have incurred $3,000 in medical bills." That doesn't make sense to us because important decisions often have to be made before that time. Evidence can be lost with the passage of time. We think it makes a lot more sense to get involved as early as possible.

A. We prefer that you come to the office. You get to meet me and my staff and that builds confidence and rapport. But, if you really can't come in we might be able to do the consultation over the phone.

Q. Will I get to meet with a lawyer?

A. YES. Absolutely.

Q. What should I bring with me?

A. Whatever paperwork etc. that is easily accessible. We can get the rest later.

Q. How long will the case take?

A. At the shortest, six months. And Utah injury legal cases can take longer. It depends on how long your treatment takes and it also depends to some extent on the insurance company and adjuster we are dealing with on the other side.

We make a strong effort to move our cases along promptly, and we have been told by some doctors we work with that we move our cases faster than the other lawyers they have had occasion to work with. Still, it is impossible to say exactly how long your case will take.

Q. Can I fire my present attorney and hire your firm?

A. Yes. We have taken over many cases from other lawyers. But first we like to find out what is your cause for complaint. If your lawyer is doing a good job on the case we don't want to penalize him by taking over your case. But if you lawyer doesn't seem to care about the case and really isn't pushing it along, we will take a serious look at replacing him or her.

Q. Will the person who caused my injury be punished?

A. The person at fault may have gotten a ticket and that is between him/her and the court. Any penalty he sustains will be because he violated the law. There is no additional penalty to him when you bring your Utah injury legal injury case.

In all my years in practice I have never collected from a person more than his insurance would pay. We are not trying to bankrupt someone or punish him/her for the accident. It's about getting compensation for you that is fair and reasonable. We get that compensation from the at fault person's insurance company.

Q. What is the likelihood that my case will go to trial?

A. Fortunately, very slim. We work very hard to avoid having to settle a case short of a lawsuit. But unfortunately, 10-15% of the time we have to file suit to compel an insurance company to pay fair money. In the process of the "litigation" most cases resolve and only a few Utah injury legal cases make it all the way to trial.
