Help! Balance Billing Question

Q. I was rear ended when i was stopped at a red light. The 72 year old woman who hit me told her insurance company that she blacked out. Her insurance company denied my claim calling the accident “an act of god.” I got a bad whiplash from the accident and my dr. is balance billing me for over $900. i have an attorney but they haven’t done anything with my case. according to a letter i received today, my dr’s. office is demanding payment in full within 5 days or they are going to start collection. do i have any rights??
A. Speak directly with the office that is demanding payment. Ask if they will take monthly payments. Or perhaps they will take what is referred to in some states as a “physician’s lien”. The name in your state may be different.
The black-out by the elderly person does not sound like an “act of god.” Personal injury cases are rarely “open and shut” as some people believe and insurance companies often assert defenses to forestall claims.
